Dear member could any help me out that whether a company whose income is declared as exempt from tax for a specific period of time is required to pay minimum tax under section 113 of the ITO 2001.

Though it is mentioned in the said section any person whose income is exempt from tax is required to pay minimum tax under the said section. But in the later half of 2010 a decision of the supreme court of Pakistan have gone through my eyes in which the supreme court give decision that if the income of a person is exempt the he is not required to pay minimum tax under section 80D of the repealed ITO 1979.

The case was of Elahi Cotton Mills Vs Federation of Pakistan

Any one could provide me the copy of that case.
