Dear Sir/Madam

If a director is getting 400,000 from salary and his share from AOP is 800,000, according to ITO share from AOP is to be added for RATE PURPOSES ONLY, will this rate be of SALARIED INDIVIDUAL CLASS or NON-SALARIED ONE as the share from AOP is more than the salary, 2nd if the share from AOP is less than salary what rates will be taken for RATE PURPOSES ONLY(salaried rates, non salaried rates), whether this share from AOP is to be taken in this case when his other income is salary as stated above. Please reply.

Sir one more thing, if a persons share from AOP is more than his salary, whether he would be called a salaried individual or business individual.

Please guide me where in ITO, 2001 it is said that share from income of AOP shall be added for rate purpose only.

Agar AOP income salary income say kam hay to tax rate salary k lagyn gay, or agar AOP income salary income say zayada hay to tax rate business income ya non salaried k lagyn gay.
Ap k case may salary income 400000 or AOP income 800000 hay is tarhan ap ki total taxable income ho gi 1200000 is par tax rate 20% k hisab say lagy ga jo k 240000 ho ga.
Agar AOP ki income taxed nahi hay to 240000 tax liability ho gi ap ki.
Agar AOP ki income par tax ada kiya gya hay to ap ko AOP rebate mily ga.
AOP REBATE = Share from AOP X Tax Liability / Total Income
Ap ka AOP tax Rebate 160000 bany ga
Jisy ap return k Colum No.35 may likhayn gay
Is tarhan ap ki tax liability decrease ho kar 80000 ho jaye gi.
Agar ap ki salary par tax withheld howa hay to ap us tax ko adjest kar layn gay jo k 6000 ho ga
Ab ap ki tax liability 74000 ho jaye gi.
Ab is may Surcharge add kar layn jo k 3237 bany ga.
